Terms of Sales
Preamble :
These general conditions of sale govern the relationship between: the buyer and Maison Ou, a company registered with the RCS Paris under number B 911 223 808, whose head office is located at 87 bis avenue de Wagram, 75017 Paris.
Article 1: object
These general conditions of sale are intended to define the terms of sale between Maison Ou and the user, from the order through payment and shipping. Any order taking supposes the preliminary consultation of the present general conditions of sale.
The user who places an order via the site expressly and unreservedly accepts all of these general conditions. Placing the order constitutes acceptance.
Article 2: Products
The products sold on the site are identified by one or more photo(s), a descriptive text and a net price in euros. The photographs taken for the site are intended to be as faithful as possible to the products sold. Colors rendered may vary from computer to computer. The photographs illustrating the products do not enter into the contractual field. If errors are introduced, in no case, the responsibility of Maison Ou can not be engaged.
Article 3: The order
The user has the possibility to place his order online from the online catalog. The prices are indicated in euros, they do not take into account delivery costs, invoiced in addition, and indicated before the validation of the order, payable at the time of the order by credit card: payment is made at your choice on the server secure banking from our PayPal or Stripe partners. This implies that no banking information concerning you passes through the Maison Ou website. Your order will be recorded and validated upon acceptance of payment by the bank.
Section 4 : The price
The prices are indicated in euros and are valid only on the date of the sending of the purchase order by the consumer. They do not take into account the delivery costs, invoiced in addition, and indicated before the validation of the order. Payment of the price must be made when ordering. At no time can the sums paid be considered as a deposit or down payment.
Article 5: Product availability and warranty
The order will be processed at the latest within seven days from the payment of the order. In the event of damage or loss, the user will be informed as soon as possible and will have the possibility of canceling his order. The user will have the choice, either to request a full refund of the sums paid within thirty days at the latest, or an exchange for one or more items from our catalog reaching the same value as that of the initial order.
Antique furniture is sold in the condition described in the detailed product sheet, it is not guaranteed. You can request additional information and photos before confirming your order.
Article 6: Confirmation of the order
The contractual information will be confirmed by email after validation and confirmation of the order form.
Maison Nomade reserves the right to cancel any customer order without reason.
Section 7 : The delivery
The products are delivered to the delivery address that you indicated to us during the ordering process. By default, the invoice will be issued to the name and delivery address. For it to be established under a different name and address, it will be necessary to specify this when placing the order in the "message to the seller" box.
We accept no responsibility for loss, damage or delay in delivery by the transport company. Never accept a damaged package or one bearing traces of opening, otherwise no recourse will be possible by our services.
The buyer or the recipient of the package is delivered to his home or to the address of his choice by post or the carrier. In case of absence, the buyer or the recipient of the parcel receives in his mailbox a delivery notice from his postman, which allows him to collect the parcel at the nearest post office, for a period of fifteen days. . After this period, the package is returned to Maison Nomade which will reimburse the amount of the item(s) directly within 30 days without the initial delivery costs. Maison Ou reserves the right to no longer accept orders from the responsible customer.
The information given by the buyer, when taking the order, commits him: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.
Products whose volume and/or weight exceed the thresholds authorized by the Post Office will be shipped by carrier. The shipment will be made at the foot of the building or at the threshold of the address indicated by the buyer.
Article 8: Delivery errors
The user must make to Maison Ou, on the same day of delivery or at the latest within 48 hours of delivery, any complaint of error of delivery and/or non-conformity of the products in kind or in quality by in relation to the indications appearing on the order form. Any complaint made beyond this period will be systematically rejected and will release Maison Ou from any liability.

Section 9 : The proof
The computerized registers, kept in Maison Nomade's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
Archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy.
Section 10 : Right to retract
The buyer has a period of 14 days to return, at his expense, the items that do not suit him. This period runs from the day of the order.
All returns must be notified in advance to Maison Nomade at the following email address: contact@maisonou.fr. The product must be returned by the same shipping method as the one by which it was initially sent. Only products returned as a whole will be taken back, in their complete and intact original packaging (without breakage, without cracks, without loss or other deterioration) and in perfect condition for resale, failing which the product will not be refunded or exchanged. .
When the return is accepted, the buyer will have the choice of requesting either a refund of the sums paid (excluding postage), or the exchange of the product with one or more products representing the same monetary value. In the case of an exchange, the reshipment will be at the buyer's expense.
The information and proof of shipment must be communicated to Maison Or by the user.
Any risk related to the return of the product is the responsibility of the buyer. In the event of non-compliance with the procedure described above and the deadlines indicated, the buyer may not make any claim for non-compliance or apparent defect of the products delivered, the products being deemed to be compliant and free from any apparent defect.
The returned product must be returned within five days of notification of the withdrawal to the following address: Maison Or - 87 bis avenue de Wagram, 75017 Paris.
Article 11: Liability
Maison Ou could not be held liable for inconveniences and damages relating to the use of the Internet network, such as a break in service, the presence of computer viruses or external intrusions or more generally any case qualified as force majeure by the courts.
Article 12: Settlement of disputes
In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, any legal action will be brought before the competent courts of the domicile of the defendant or within the jurisdiction of the registered office of Maison Ou.
These conditions are subject to French law.
Article 13: Intellectual property
All the elements making up the entire site are and remain the exclusive intellectual property of Maison Ou (photographs, graphics, texts, logos, creations, database, etc.). No one is authorized to reproduce, exploit, distribute or use the elements of the site.
